Could the EU Charter be a Defense to the Snooper's Charter

Continuing the discussion from European Court of Justice Strikes Down Safe Harbor Agreement:

I was reading the post on the new Snoopers Charter:

And wondering to myself, if you couldn’t make an argument that such a law was contrary to the Article 7 and 8 rights under the EU charter? The ECJ and the Advocate General really laid down strong arguments about the need for government’s and companies alike to honor the Charter. I wonder if that would be recognized as a defense to this law, even if it does pass?

I don’t think so because I think there’s a blanket get out for “national security”. Need checking though.
